Terms of Service Agreement

This Terms of Service Agreement (“Agreement”) is between Michelle Gomez, doing business as Newport Notary and Document Services, LLC (the “LDA”) and you (the “Client”), for the self-help services described below.

1. Operational Matters
   a) The Client should read and understand this Agreement before making an online purchase (signing) and should be aware of the services LDA can and cannot provide (see Performance and Self-Help Services).
   b) LDA is not a licensed attorney and cannot perform legal services or engage in the practice of law.
   c) LDA strictly complies with local laws and regulations, ensuring no false or misleading statements are made.
   d) LDA has no influence or special favors with any court or governmental agency.

2. Performances and Self-Services
   ​a) LDA will provide Client all the following services.
   ​     i) Services selected by Client on the Newport Notary and Document Services, LLC website (“Website”), added to the cart, and paid for.
        ii) The services provided are strictly as listed on the Website and chosen by the Client, with no additional guarantees or promises.
   b) For legal matters where Client represents themselves, LDA may provide the following self-help services:
        i) Typing or completing legal documents as per the Clients specific instructions.
        ii) Providing general, attorney-approved factual information to aid in self-representation.
        iii) Supplying published legal documents.
        iv) Filing and serving legal forms and documents as directed by Client.
   c) Self-help services are only provided for matters where the Client represents themselves.
   d) LDA cannot engage in the practice of law, meaning they cannot provide legal advice, opinions, or recommendations on rights, remedies, or strategies, nor choose Client’s forms.

3. Services Rendered 
   As entered by Client during their online purchase.

4. Fees and Expenses 
   The Client agrees to compensate LDA for the following fees, costs and expenses:
   a) Flat fees associated with selected services listed on the Website. This does not include filing, recording, courier and/or process server fees.
   b) Additional fees may apply for document preparation, additional pages or revisions.
   c) All fees must be paid in advance of performing services.

5. Insurance
   Michelle Gomez and Newport Notary and Document Services, LLC are licensed and insured.

6. Confidentially/Non-Disclosure 
   LDA shall not directly or indirectly disclose or make use of any secret or confidential information or material provided by Client.

7. Maintenance of Records
   LDA does not retain original documents. Upon request or termination of this Agreement, Clients documents will be promptly returned.

8. Termination
   a) Within 24 hours of acceptance and payment, the Client may cancel the Agreement for any reason, with a full refund issued.
   b) LDA may retain fees only for services rendered within the initial 24-hour period.
   c) Cancellation requires written notice sent by first-class mail to the address provided below.
   d) The Client retains the right to cancel for legal cause at any time.

9. Indemnification
   The Client shall indemnify and hold Newport Notary and Document Services, LLC and any of its officers or agents harmless from any loss or liability arising from performance of services under this Agreement.

10. Dispute Resolution
    LDA and Client agree to mediate any dispute or claim arising out of this Agreement or any resulting transaction before resorting to arbitration or court action.

11. Governing Law
    This Agreement shall be governed by the laws of the state of Oregon.

12. Entire Agreement
    This Agreement represents the entire agreement between LDA and the Client, superseding any previous oral or written communications, representations, understandings or agreements with Newport Notary and Document Services or any of its officers or agents.

13. Severability
    If any provision (or portion thereof) of this Agreement is held by a court of competent jurisdiction to be invalid, void, or otherwise unenforceable, the remaining provisions shall remain enforceable to the fullest extent permitted by law.

14. Notice
    All notices and other communications required or permitted in accordance with this Agreement shall be in wiring and shall be mailed by registered or certified mail, postage prepaid to the address listed below.
